You are about to sign the transfer deed for your new house, but you are not a native Dutch speaker. Pursuant to the Dutch Civil-law Notaries Act, you will then have to hire an interpreter, who can assist you during the execution of the transfer deed and mortgage deed. This assures the civil-law notary that you understand the substance of these documents.
How it works
Congratulations! You are almost the owner of your new house! You had to go through a lot of red tape, but now you are about to make the purchase official. To do so, the civil-law notary will go through the transfer deed and the mortgage deed with you, after which you will sign them. This is called executing the deeds.
Transfer deed
The transfer deed is first on the list. The civil-law notary will summarise the substance of it, often together with the sellers. If the sellers are not present, one of the notary’s employees will have been given a power of attorney to sign on their behalf. When the notary has gone through the deed, the buyers, sellers, interpreter and notary sign the deed.
Mortgage deed
Second on the list is the mortgage deed. Again, the civil-law notary discusses the substance of the deed, but this time just with the buyers and interpreter, after which the deed is signed by the remaining parties present. An employee of the notary signs on behalf of the bank, who will have authorised the employee to do so, as a bank representative is never present in person on these occasions.
Duration
The civil-law notary then often discusses a few more documents, like the bank’s offer and the notary’s completion statement, and any other important details with you. Altogether, this will not normally take more than one hour.
