If you have bought a house together and you break up, one partner can buy out the other partner. To record this, you have to have a deed of division drawn up by a civil-law notary.
Provisions
Reference in the deed of division is made, for example, to:
- the description of the joint property
- the assets and liabilities
- the acquisition of ownership
- the mortgage / the pledge
- the division and what happens if more than a rightful share is received by one party
- release from joint and several liability under the mortgage and any other debts
- discharge regarding the division
